HENTIKAN SEKATAN PERJALANAN PLHIV

Rupa-rupanya nak melancung keluar negara pun kita yang positif hiv (PLHIV) menghadapi masaalah juga kan. Bayangkan masih ada negara yang akan menafikan kemasukan PLHIV kenegara mereka. Masih ada negara yang mengenakan berbagai-bagai peraturan. Bayangkan seorang PLHIV yang kerjanya berpindah dari satu negara ke negara lain, meeting dari satu benua ke satu benua lain, sudah tentu mereka semua akan menghadapi masaalah bila ketika berada disetiap pintu masuk kenegara-negara tersebut.

Sebenarnya kebanyakan dari kita semua disini tidak ambil kisah tentang hal seperti ini, termasuklah diri saya ini. Ya dulu kita bukan ada hiv, so buat apa nak ambil tahu tentang masaalah sebegini, kalau kemana-mana negara pun dulu memang tidak menjadi masaalah. Tapi bagi diri saya yang sejak mula berkecimpung dan bergelumang dengan virus hiv masaalah seperti ini pun sudah menjadi sesuatu yang perlu saya kena fikirkan, masaalah seperti ini bakal saya hadapi kemungkinan pada suatu hari nanti dimasa yang akan datang.


PLHIV go away.

Wabak hiv akan berterusan bersama kita. Hiv akan hidup dalam masyarakat dunia selama-lamanya selagi tiada penawarnya yang ditemui. Ada sesetengah pihak beranggapan PLHIV tidak ada hak untuk melancung, seolah-olah PLHIV itu akan sentiasa akan  membawa masaalah, maka usah lah berjalan jauh duduk aje dalam negara masing-masing dan kalau nak melancung pun, melancung aje dalam negeri. Walaupun terdapat kemajuan dan peningkatan besar tentang pemahaman virus hiv tetapi masih banyak negara-negara didunia yang masih tidak faham akan sifat sebenar cara jangkitan hiv dan risikonya. Dan kerana mereka kurang pemahaman tentang hiv maka mereka masih mengekalkan undang-undang dan peraturan-peraturan mendiskriminasi terhadap PLHIV. 

China lifts 20-year-old entry ban on HIVAIDS infected foreigners

Negara seperti China telah menarik sekatan pengharaman imigresen mereka terhadap PLHIV yang berlanjutan selama hampir 21 tahun. Undang-undang yang melarang orang asing yang positif HIV daripada memasuki China telah dikuatkuasakan pada tahun 1985. Sejak pengharaman itu dikenakan, orang yang memasuki negara ini untuk lawatan jangka pendek perlu mengisytiharkan status HIV mereka disempadan dan orang-orang yang tinggal lebih lama daripada enam bulan perlu pula menjalani ujian darah. 

Manakala Amerika Syarikat juga telah menarik larangannya yang telah berlanjutan selama hampir 23 tahun. Tetapi malangnya masih terdapat hampir 66 buah negara didunia yang terus menghadkan perjalanan PLHIV disertai dengan pelbagai kerenah dengan pihak imigresen. 



Dibawah ini sebahagian ciri-ciri dengan berbagai kerenah yang terpaksa dihadapi oleh PLHIV ketika berhadapan peraturan dan dasar-dasar yang ketat dibeberapa negara yang berkaitan dengan hiv

Pengisytiharan HIV yang Diperlukan

Saya sebenarnya mempunyai cita-cita besar satu hari nanti insyaallah sekiranya kiraan CD4 saya melebihi 500 menjelang 3 tahun yang akan datang dan disertai dengan tubuh badan yang kuat dan sihat insyaallah saya ingin "travel". Ini adalah cita-cita utama saya tetapi dalam keadaan suasana sekarang yang kebanyakan negara menghadkan PLHIV masuk adakah akan sukar perjalanan saya itu nanti

Saya masih belum mahu "check" atau teliti segala peraturan keluar masuk ke setiap negara-negara tersebut, cuma yang saya harap dan berdoa selalu agar apa jua peraturan yang menghadkan perjalanan terhadap PLHIV akan mengalami perubahan yang besar terutama dinegara yang saya sebutkan diatas ketika menjelang 3 tahun yang akan datang. Sekiranya tiada diskriminasi tentu kita PLHIV dapat melancung atau mengembara dengan tenang kan.

Jika masih tidak berubah segala peraturan perjalanan di negara tersebut misi tetap akan diteruskan dan hanya bertawakal serta berdoa pada Allah semoga segalanya akan dipermudahkan insyaalla  :)

As the HIV and AIDS epidemic continues worldwide, many foreign countries are requiring HIV tests prior to entry. Below you will find the most current requirements and restrictions for countries "A" through "Z".

Albania
No restrictions

Algeria
Citizens returning from work abroad and members of the military are required to take an HIV test.

Angola
A negative HIV certificate is required to obtain a residence visa to work.

Anguilla
Foreign nationals suspected of or known to be HIV positive have been refused entry.

Argentina
No restrictions on visits of less than 3 months. Foreigners suffering from any illness that impairs their ability to work will not be admitted.

Armenia
Entry prohibited for HIV positive people. Anyone who falls ill while visiting may be deported.

Aruba
Testing is required for intending immigrants.

Australia
All applicants for permanent residence over age 15 (All other applicants who require medical examinations are tested if it is indicated on clinical grounds.)

Austria
No national restrictions although some cities require an HIV negative certificate to apply for residence. Health certificates required for non-EU citizens staying more than 6 months.

Azerbaijan
No restrictions.

Bahamas
The Ministry of Health has recommended that anyone HIV positive not be admitted into the country.

Bahrain
Individual employed in jobs involving food handling and patient or child care.

Bangladesh
No official restrictions but it is possible for HIV positive people to be deported if the authorities find out about their diagnosis.

Barbados
No restrictions for short term visits however it is unlikely HIV positive people would be admitted into the country for a long-term visit.

Belarus
All persons staying longer than 3 months require HIV testing.

Belize
All persons applying for citizenship must produce an HIV negative test certificate.

Benin
HIV test required for longer term stays.

Bolivia
Anyone staying more than 90 days and any applicants for work permits will be required to provide evidence of their HIV status.

Bosnia-Herzegovina
No restrictions however anyone applying for permanent residence must produce an HIV negative test result.

Botswana
HIV testing required for all students.

Brazil
No entry restrictions for HIV positive people.

Brunei
People known to be HIV positive are prohibited from entry. Anyone found to be HIV positive will be expelled from the country. Doctors are required to report any HIV positive tests.

Bulgaria
All intending immigrants (and may be required for foreigners staying longer than 1 month for purposes of study or work) Bulgaria revises its legislation on entry and residence for people with HIV. New rules on HIV testing are effective from March 2010 onwards. Under the old rule, mandatory HIV tests were possible on entry for foreigners suspected of being a danger to public health. Mandatory HIV tests are now only possible for certain groups, like people who need blood dialysis.

Burkina Faso
No entry restrictions for HIV positive people. Visitors needing a entry visa must be vaccinated against yellow fever. Since the yellow fever vaccine is a live vaccine, HIV positive people can't receive that vaccine and therefore can't get an entry visa.

Burundi
No restrictions for HIV positive people.

Cambodia
No restrictions for HIV positive people.

Camaroon
No restrictions for HIV positive people.

Canada
No longer requires disclosure of HIV status for a temporary resident visa or for short term visitors.

China, People's Republic of
Those staying more than 1 year. (Testing is not required for entry or residency in Hong Kong.) In April the Chinese government announces the lifting of the 20- year-old entry ban affecting people living with HIV. This is a great step forward, but a number of critical questions remain unanswered: at the time of writing, we have not seen translations of the new entry and residency regulations nor the new visa application forms. It is therefore not clear how the new law will be implemented in practice and how fast this is happening. It is furthermore unclear whether prospective visitors will be asked to declare their HIV status on visa application forms at entry.

Colombia
Anyone suspected of being HIV positive. (HIV positive persons are not admitted without a waiver from a Colombian consulate in the U.S.)

Costa Rica
No restrictions specific to HIV however a health certificate is required for those wishing to work or live in the country.

Croatia
No restrictions for HIV positive people.

Cuba
Foreign students, foreign workers and long-term foreign residents are screened for HIV; people found to be HIV-positive are reportedly repatriated.

Cyprus
All foreigners working or studying are tested after entry.

Czech Republic
No restrictions for HIV positive people. The Czech Republic announces in May 2009 that visa applicants from 10 countries must present an HIV test in order to enter the country. The new legislation applied to citizens from Congo, Kenya, Moldova, Mongolia, Nigeria, Pakistan, Tajikistan, Turkmenistan, Ukraine and Vietnam. The discriminatory proposition is withdrawn after mass protest by the HIV community throughout Europe, including an open letter by the EATG (http://www.eatg.org/eatg/Position-statements/Open-letters/Letter- on-Czech-Republic-Visa-Restrictions-for-People-Living-with-HIV). The administration quietly drops the plan.

Denmark
No restrictions for HIV positive people.

Dominican Republic
Foreigners seeking residency

Ecuador
An HIV negative test is required for a work permit of an application for permanent residency.

Egypt
Foreigners requiring work permits (spouses of work permit applicants are exempt)

El Salvador
HIV test required for people over 15 years old seeking permanent residency.

Eritrea
No restrictions for HIV positive people.

Estonia
No restrictions for HIV positive people unless applying for a work permit or residence.

Estonia
Foreigners seeking residency or work permits

Ethiopia
No HIV related restrictions.

Fiji
HIV positive people are not allowed to enter the Fiji Islands.

Finland
No restrictions but anyone knowingly transmit HIV may be deported.

Gabon
No HIV specific restrictions but a medical certificate is required for entry.

Georgia
All foreigners staying longer than 1 month

Germany, Federal Republic of
Applicants staying 180 days or longer in Bavaria (This requirement is for Bavaria only.)

Ghana
No HIV related restrictions.

Greece
Prostitutes (as defined by Greek law)

Guatemala
No HIV related restrictions.

Guinea
No HIV related restrictions.

Guyana
All foreigners staying longer than three months

Haiti
No HIV related restrictions.

Honduras
A medical certificate is required for a visa.

Hungary
Anyone staying over 1 year, and all intending immigrants (some employers may require workers to be tested)

Iceland
No HIV related restrictions however anyone found to have HIV is immediately entered into the national healthcare system.

India
All students over 18, anyone between the ages of 18 and 70 with a visa valid for 1 year or more, and anyone extending a stay to a year or more, excluding accredited journalists and those working in foreign missions. The Indian Ministry of External Affairs lifts all travel curbs against HIV-positive people.

Indonesia
Anyone HIV positive people are subject to residence regulations. We receive notice that the Education Department has started enforcing an old requirement that foreign teachers must be free of HIV. 

Iran
Anyone staying more than 3 months must produce an HIV test certificate.

Iraq
People with HIV are not allowed to enter the country. Anyone found to be HIV positive are immediately expelled from the country.

Ireland
No HIV related restrictions.

Israel
No HIV restrictions but anyone staying longer than 3 months must disclose their HIV status and have medical insurance.

Italy
No HIV related restrictions.

Jordan
Anyone staying longer than 3 months

Kazakstan
All visitors, excluding diplomats, must present a certificate of an HIV test within 10 days

Korea, Republic of
Foreigners working as entertainers staying over 90 days

Kuwait
Those seeking to obtain a residence permit

Kyrgyzstan
All foreigners, excluding diplomats, staying more than a month

Lebanon
Those planning to live or work

Libya
Those seeking residency permits, excluding official visitors

Lithuania
Applicants for permanent residence permits

Maldives
Long-term visitors

Malaysia
Foreigners seeking work permits as unskilled laborers

Marshall Islands, Republic of the
Temporary visitors staying more than 30 days and applicants for residence and work permits

Mauritius
Foreigners planning to work or seek permanent residence

Micronesia (Federated States of)
Anyone staying over 90 days and anyone holding a work permit

Applicants for residency/work permits

St. Vincent
Applicants seeking temporary and permanent residency visas

St. Kitts and Nevis
Students, intending immigrants and anyone seeking employment

Seychelles
Foreigners planning to work must produce a medical certificate, including the results of an HIV test

Singapore
Workers who earn less than $1,250 per month and applicants for permanent resident status (except spouses and children of Singapore citizens)

Slovakia
Applicants for long term or permanent residency visas

South Africa
All mine workers (irrespective of their positions)

Spain
Anyone seeking residence, work and student permits must submit to a medical exam (which may include an AIDS test)

Syria
All foreigners (ages 15 to 60 years) staying more than 15 days, or planning to marry a Syrian national while in Syria

Taiwan
Applicants for residency and work permits (Testing is also required for anyone staying over 90 days.)

Tajikistan
Anyone staying more than 90 days (pending legislation)

Turkmenistan
All foreigners suspected of being HIV positive. (Foreigners with AIDS or who are HIV positive are prohibited from entering Turkmenistan.)

Turks and Caicos Islands
Foreign workers (HIV testing is part of the medical exam that is required for work permits.)

United Arab Emirates
Applicants for work or residence permits except those under age 18

Ukraine
Anyone staying longer than 6 months and all applicants for permanent residency. The Ukrainian Parliament revises its Law on Prevention of AIDS and Scoial Protection of Population in October 2010. Restrictions on entry of people living with HIV are removed from the law.

United Kingdom
Anyone who appears unwell may be tested. (A positive test result may cause applicants to be denied entry into the UK.)

Uzbekistan
Anyone staying more than 15 days (Long-term visitors must renew HIV certificate after the first 3 months in Uzbekistan and annually thereafter.)

Yemen
Applicants for permanent residence and work or study permits, all foreigners staying longer than 1 month, and foreign spouses of Yemeni nationals


Foreigners coming to get a look and feel of  Incredible India won't be required to declare their HIV status while filling their visa forms. India has lifted all travel restrictions against HIV-positive patients.

Sebenarnya banyak links yang boleh kita perolehi dan pelajari serta kita fahami tentang maklumat perjalanan ke luar negara yang nak saya share kan disini tetapi takut orang jemu tengok entry yang berjela-jela panjangnya pulak. Kalau saya share dan letak banyak links sekali pun buat apa siapa yang nak tengok dan siapa nak "klik" kan, kalau kita tidak berhasrat nak melakukan perjalanan dalam masa terdekat ini. Walau bagaimanapun saya berharap entry ini sikit sebanyak dapat menyedarkan kita semua bahawa masih terdapat diskriminasi seperti ini yang masih wujud berlaku kepada PLHIV di dunia pada ketika ini.
Sekiranya kita PLHIV terutama yang telah pun memulakan rawatan HAART  berhasrat ke luar negara elok sangatlah anda mencari maklumat tentang perjalanan terlebih dahulu. Bagi mereka yang belum memulakan HAART perjalanan anda agak mudah dan tidak perlu risau. Terdapat beberapa laman web yang memberi panduan nasihat yang agak terperinci dan menarik melibatkan segala aspek yang sangat baik buat kita PLHIV merujuk sebagai persediaan sebelum berangkat.
Contohnya kita disaran mendapatkan surat perakuan dari doktor tentang maklumat ubaatan HAART yang kita bawa, lebih baik sekiranya ubatan HAART yang kita bawa disahkan oleh doktor sebagai ubatan untuk penyakit lain seperti ubat tekanan darah tinggi misalnya supaya apabila kita berurusan di imigresen semuanya akan berjalan dengan lancar kerana sekiranya kita mengaku ubat yang kita bawa adalah ubatan untuk hiv kemungkinan nanti bermasaalah pulak kita bila berdepan dengan pegawai-pegawai di imigresen. Silap haribulan negara yang kita sangka senang untuk kita masuk sebaliknya akan mengarah kita supaya berpatah balik pulang kembali ke tanah air hanya kerana status hiv kita itu.

  3. Saya pernah berdoa pd Allah bercita-cita nak duduk diYaman..dlm 6 bulan pun
    jadi le..nak mohon cuti keje tanpa gaji...tapi bila dah bc n3 ni...susahnya kita nak dapat buat mcm tu skrg kan..lebih2
    lagi kita yang PLHIV ni.....sedihnya.....apa pun segala aturan Allah tu terbaik kan.....

    Bila dah ada HIV, kita sudah tidak mudah untuk melancung sesuka hati. Kita juga perlu ingat pada bekalan ubatan dan rasanya kita terpaksa "tipu" sunat untuk masuk kenegara2 yang keras peraturannya itu.

    Tetapi semua itu peraturan yang dicipta manusia. Kalau kita hendak ke mana2 yang penting niat dan doa pada Allah saya percaya segala urusan kita akan dipermudahkanNYA... ..:)
